MINUTES OF THE BROOKNEAL TOWN COUNCIL
7:00 PM – The regular meeting of the Brookneal Town Council
The municipal government of the Town of Brookneal met with the following members present:
Phyllis Campbell, Mayor
Jack Woodell, James Nowlin, Meg Tibbs, Lee Booker, Tracy Meisenbach and Kenneth Jennings Council members
Bill Gillespie, Jr., Town Manager
Laurie C. Francis, Clerk/Treasurer
Mike Crews, Public Works Director
Jim Hires, Police Chief
*** PUBLIC HEARING ON CONDITIONAL USE PERMIT ***
Mayor Campbell declared the Public hearing open at 7:00 PM
Kenneth and Kimberly Jennings of Hale Street filed for a conditional use permit in a R-1 residential zone to remove an existing mobile home and replace it with a 16 ft. x 76 ft. mobile home.
No one from the public appeared in favor or in opposition of the conditional use permit.
Mayor Campbell declared the Public Hearing closed at 7:05 PM.
APPROVAL OF CONDITIONAL USE PERMIT
Jack Woodell presented the Council with a recommendation from the Planning Commission that the conditional use permit requested by Kenneth and Kimberly Jennings be approved.
Motion was made by Council member Lee Booker that the Conditional Use Permit for Kenneth and Kimberly Jennings be approved with the condition the Mr. & Mrs. Jennings must appear before council to request approval should they ever decided to sell.
The Motion received a second from Council Member James Nowlin and was unanimously carried.
APPROVAL OF AGENDA
Upon motion by Meg Tibbs, seconded by Jack Woodell and unanimously carried, Council approved the agenda for the October 14, 2003 regular meeting of the Brookneal Town Council.
MINUTES
Upon motion by Lee Booker, seconded by Kenneth Jennings and unanimously carried, Council approved the September 9, 2003 minutes.
PRESENTATION AND APPROVAL OF BILLS
Be it resolved that motion was made by James Nowlin, seconded by Kenneth Jennings and unanimously carried, authorizing the payment of the invoices for the period of September 9, 2003 to October 13, 2003 in the amount of $28,732.53.
PUBLIC COMMENT
Mr. Alan Taylor of 101 Terry Road appeared before Council asking for relief from the town with a drainage problem at his residence.
Mr. Taylor presented council with pictures of flooding that had taken place in his basement. Mr. Taylor stated “All we want is the problem solved.” Mr. Taylor requested that the town dig a trench going down through the woods so that the wash water from his property would have a proper place to drain.
Town Manager, Bill Gillespie, informed Mr. Taylor that the Town has met with VDOT and VDOT is adamant that they will not do any work until Mr. Taylor takes corrective action to insure that the wash water is going in a separate drain.
After a lengthy discussion, Council Member Lee Booker made a motion that the Town work with the State and get back with Mr. Taylor as soon as possible. The motion was seconded by Kenneth Jennings and unanimously carried.
The issue will be brought back to council for a vote at a later meeting.
Mr. Billy Rudder appeared before council to complain of the same drainage problem as Mr. Taylor.
CAMPBELL COUNTY ANNUAL FINANCIAL CONRIBUTION
Campbell County Supervisor, J.D. Puckett and Campbell County Administrator, David Laurrell presented the Town with a check for $63,000.
In speaking to Council, Mr. Puckett noted that the County and the Town have an excellent working relationship.
Mr. Laurrell stated that the county appreciates the cooperation it receives from the Town and one of the goals of the County was to be more public with the support that it gives to the Towns.
ANNUAL AUDIT REPORT
Mr. Jerry Reynolds, auditor for the Town, gave his annual financial report to Council. Mr. Reynolds stated that the town is financially stable. In regards to GASB 34 Mr. Reynolds noted that the town is in better shape than most areas. The one big pitfall, according to Mr. Reynolds, is that the town is required to do an inventory of its assets. Mr. Reynolds noted that all assets have been put on the books since 1957.
SET DATE FOR CLEAN UP WEEK
Council set the dates for clean up week to be from October 27 through November 7, 2003.
CLOSED SESSION
Upon motion from James Nowlin, seconded by Meg Tibbs and unanimously carried, Council went into closed session in accordance with Virginia State Code Section 2.2-3711 (A1) the purpose of which was to discuss the selection process of the Town’s next Police Chief.
RETURN FROM CLOSED SESSION
Upon motion by Jack Woodell, seconded by Meg Tibbs and unanimously carried council voted to return from closed session.
CERTIFICATION
Mayor Campbell moved that the town council certify that, in the closed meeting just concluded, nothing was discussed except the matter specifically identified in the motion to convene in a closed meeting and lawfully permitted to be so discussed under the provisions of the Virginia Freedom of Information Act cited in that motion. ACCEPTANCE OF APPLICATION PROCESS
Motion was made by Meg Tibbs to accept the application process for Chief of Police as presented by the Town Manager and proceed as soon as possible.
The motion received a second from James Nowlin and was unanimously carried.
ADJOURNMENT
Upon motion by Meg Tibbs, seconded by James Nowlin and unanimously carried, council adjourned.
