MINUTES OF THE BROOKNEAL TOWN COUNCIL
7:00 PM – The regular meeting of the Brookneal Town Council
The municipal government of the Town of Brookneal met with the following members present:
Phyllis Campbell, Mayor
Jack Woodell, James Nowlin, Meg Tibbs, Lee Booker, and Tracy Meisenbach, Council members
Joseph R. Williams, Town Manager
Laurie C. Francis, Clerk/Treasurer
Mike Crews, Public Works Director
Jim Hires, Police Chief
7:02 PM PUBLIC HEARING ON CABLE FRANCHISE AGREEMENT
Mayor Campbell declared the public hearing on the cable franchise agreement open at 7:02 p.m.
No one appeared to speak for or against the cable franchise agreement.
Mayor Campbell declared the public hearing closed at 7:04 p.m.
APPROVAL OF AGENDA
Upon motion by Meg Tibbs, seconded by James Nowlin, and unanimously carried, council approved the agenda.
MINUTES
Upon motion by James Nowlin, seconded by Meg Tibbs and unanimously carried, council approved the February 11, 2003 minutes.
TREASURER’S REPORT
The Treasurer’s Report was filed for audit.
PRESENTATION AND APPROVAL OF BILLS
Be it resolved that motion was made by James Nowlin, seconded by Lee Booker and unanimously carried, authorizing the payment of the invoices for the period of February 11, 2003 to March 10, 2003 in the amount of $12,791.69.
POLICE REPORT
Police Chief, Jim Hires, informed council that there was one reportable crime during the previous month. Chief Hires also spoke on the issue of the Dog Confinement Ordinance stating that this was not just a Brookneal problem but a Campbell County problem as well.
Chief Hires added that since the last council meeting there had been numerous complaints regarding dogs within the town.
PUBLIC INPUT
Council Member Jack Woodell expressed appreciation on behalf of the Patrick Henry Memorial Library staff for the assistance they received from the town when a window was recently busted out of the front of the library building.
Mark Roberts spoke on behalf of the Brookneal Dixie Youth Girls League requesting assistance in repairing the fence at the girl’s field. Mr. Roberts stated that the fence is falling down and poses a safety issue for the children as well as the general public. Mr. Roberts presented council with a quote from Quinn’s Home improvements out of Lynchburg, Virginia in the amount of $3,493.60 for the repairs.
Brookneal Police Officer, Ricky Cousins, offered assistance with labor from the American Legion.
Mrs. Hope Wright appeared before council asking permission to sell her business, Rise N Shine Daycare, to EZTel. According to the Conditional Use Permit issued to Mrs. Wright, council must approve any changes in ownership of the business.
Tim Boggs of EZTel informed Council that his company would continue to operate Rise N Shine as a Daycare. Mr. Boggs noted that the reason EZTel was interested in purchasing the business was to continue to provide daycare as a benefit to their employees as well as the public.
EXTENSION OF CONDITIONAL USE PERMIT
Upon motion by Jack Woodell, seconded by James Nowlin, and unanimously carried council approved extending the conditional use permit to allow EZTel to operate a business in the same location as Rise N Shine as long as it remained a daycare.
PUBLIC INPUT CONTINUED
Ms. Bonnie Woosley appeared before council to complain about the property beside her stating that it was dangerous and rat infested. Ms. Woosley also complained that her water/sewer bill had been steadily increasing over the last six months and asked that someone look into it.
Mrs. Elizabeth Handy of C.F. Gray Street appeared before council to complain about children running and riding their bicycles up and down her street. Mrs. Handy also complained of people from other counties placing their trash in the dumpsters in town and asked if there was anything that could be done about this. Mrs. Handy once again informed council that she still had low water pressure at times and wanted to know when something would be done about this.
DOG CONFINEMENT ORDINANCE
After a lengthy discussion council made no motion regarding the Dog Confinement Ordinance. The issue died for lack of a motion.
BASIC CODE UPDATE
Town Manager, Joseph Williams, informed council that the town now had three copies of the Basic Code Update. These would be given to the Legislative Committee for review and one would be available in the Town Office for other members of council to review.
BUILDING RENTAL REQUEST
Be it resolved that motion was made by Meg Tibbs and seconded by Lee Booker to rent part of the Kersey Building out to Tonchie Mason at a cost of $500 per month. Voting was as follows:

Tracy Meisenbach – Aye
With all in agreement, the motion carried.
CABLE FRANCHISE AGREEMENT
Upon motion by Jack Woodell, seconded by James Nowlin and unanimously carried council approved the Cable Franchise Agreement with Three Rivers Cable Associates, L.P. D/B/A Adelphia Cable Communications.
FIRE DEPARTMENT DEED TRANSFER
Upon motion by Lee Booker, seconded by James Nowlin and unanimously carried, council voted to transfer the deed for the Fire Department to the Brookneal Volunteer Fire Department.
ADJOURNMENT
Upon motion by James Nowlin, seconded by Meg Tibbs and unanimously carried, council adjourned.
