MINUTES OF THE BROOKNEAL TOWN COUNCIL
7:00 PM – The regular meeting of the Brookneal Town Council
The municipal government of the Town of Brookneal met with the following members present:
Phyllis Campbell, Mayor
James Nowlin, Vice Mayor
Meg Tibbs, Kenneth Jennings, Tracy Meisenbach, Richard Adams, and Stacey Hailey Council Members
Bill Gillespie, Town Manager
Laurie C. Francis, Clerk/Treasurer
Mike Crews, Public Works Director
Ricky Cousins, Police Chief
INVOCATION AND PLEDGE OF ALLEGIANCE TO THE FLAG
PUBLIC HEARING
USDA INTENT TO APPLY
Mayor Campbell opened the public hearing up at 7:05 p.m.
No one from the public appeared in favor of or in opposition to the Town’s intent to apply for a USDA grant/loan for the upgrading of the Town’s water system.
Mayor Campbell closed the public hearing at 7:07 p.m.
MOTION FOR INTENT TO APPLY
James Nowlin made a motion to give authorization to the Town Manager to file the necessary application and pursue the grant/loan option with USDA. The motion received a second from Tracy Meisenbach.
Voting was as follows:

Mr. Hailey Aye Mr. Jennings Aye Ms. Meisenbach Aye
With no one opposed, the motion carried.
APPROVAL OF AGENDA
Upon motion by Kenneth Jennings seconded by Meg Tibbs and unanimously carried, Council approved the agenda for the April 12, 2005 regular meeting of the Brookneal Town Council with the following additions: 1) Approval of resolution to apply to be a member of the Main Street program for the Town’s Revitalization.
MAIN STREET PROGRAM RESOLUTION
Motion was made by Kenneth Jennings to adopt a resolution authorizing participation in the DHCD Commercial District Affiliate Program and authorizing the Town Manager, Bill Gillespie, to handle the paperwork and sign all documents. The motion received a second from Tracy Meisenbach. With all in favor, the motion carried and the following resolution was adopted:
A RESOLUTION AUTHORIZING PARTICIPATION
IN THE DHCD COMMERCIAL DISTRICT AFFILIATE PROGRAM
WHEREAS, the Virginia Main Street has established the DHCD Commercial District Affiliate Program in the Virginia Department of Housing and Community Development to assist localities in developing public/private efforts to revitalize their downtown commercial areas, and
WHEREAS, interested Virginia cities, towns, and counties that are exploring downtown revitalization, those that may not be eligible for designation or those that do not wish to meet Main street requirements may participate as an Affiliate, and
WHEREAS, the Town of Brookneal desires to participate in the DHCD Commercial District Affiliate Program,
NOW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF BROOKNEAL
SECTION 1. That the Town of Brookneal applies for selection to participate in the DHCD Commercial District Affilitate Program with the specific goal of economically revitalizing the designated downtown district within the context of historic preservation using the Main Street Approach;
SECTION 2. It is recognized that downtown revitalization requires an on-going commitment, continuous attention and a full public-private partnership. The Main Street Program is considered one of many economic and community development tools used by a locality.
SECTION 3. The town of Brookneal understand that participation as an Affiliate Community does not guarantee selection as a Designated Main Street Community, and we will be eligible to receive Affiliate Community services from Virginia Main Street as long as the requirements stated in the Program Guidelines are met.
SECTION 4. That bill Gillespie, as Town Manager, is designated to assist in the submission of the application.

MINUTES
Upon motion by Richard Adams, seconded by Meg Tibbs and unanimously carried, Council approved the March 8, 2005 minutes.
TREASURER’S REPORT
The February 2005 and March 2005 Treasurer’s reports were filed for audit.
PRESENTATION AND APPROVAL OF INVOICES
Be it resolved that motion was made by James Nowlin, seconded by Richard Adams and unanimously carried, authorizing the payment of the invoices for the period of March 8, 2005 to April 11, 2005 in the amount of $9,116.30.
PUBLIC COMMENT
Jack Carwile of Adams Ferry Road in Brookneal expressed his concern to council about the large logging trucks that speed up and down Main Street.
Council listed to Mr. Carwile’s concerns and noted that they would be looking into in it.
PUBLIC WORKS REPORT
Public Works Director, Mike Crews noted that the Town would be flushing the water lines April 25, 26 and 27 of 2005.
DIXIE YOUTH BASEBALL FUNDING REQUEST
Upon motion by Meg Tibbs, seconded by James Nowlin and unanimously carried, council approved contributing $2000.00 towards the Brookneal Dixie Youth Baseball league & Bass Tournament and $2000 towards the Brookneal Dixie Youth Girl’s Softball league.
CLOSED SESSION
Upon motion from Stacey Hailey, seconded by Meg Tibbs and unanimously carried, Council went into closed session under VA Code Section 2.2-3711 (A)(7) for the purpose of consultation with the Town Attorney retained by the town of Brookneal regarding specific legal matters requiring the provision of legal advice by such council such matter being the discussion of legal requirements for ensuring compliance with the fair labor standards act.
CERTIFICATION
Mayor Campbell moved that the town council certify that, in the closed meeting just concluded, nothing was discussed except the matter specifically identified in the motion to convene in a closed meeting and lawfully permitted to be so discussed under the provisions of the Virginia Freedom of Information Act cited in that motion. Voting was as follows:
