MINUTES OF THE BROOKNEAL TOWN COUNCIL
7:00 PM – The regular meeting of the Brookneal Town Council
The municipal government of the Town of Brookneal met with the following members present:
Phyllis Campbell, Mayor
James Nowlin, Vice Mayor
Kenneth Jennings, Richard Adams, Stacey Hailey, Tracy Meisenbach and Robert Jean, Council Members
Bobbie Waller, Clerk/Treasurer
Mike Crews, Public Works Director and Interim Town Manager

INVOCATION AND PLEDGE OF ALLEGIANCE TO THE FLAG
APPROVAL OF AGENDA
Upon motion by Kenneth Jennings, seconded by Stacey Hailey and unanimously carried, Council approved the agenda for the August 14, 2007, regular meeting of the Brookneal Town Council.
MINUTES
Upon motion by Tracy Meisenbach, seconded by Stacey Hailey and unanimously carried, Council approved the July 10, 2007 Town Council minutes.
TREASURER’S REPORT
Mayor Campbell asked that the August 2007 treasurer’s report be filed for audit.
PRESENTATION AND APPROVAL OF INVOICES
Be it resolved that motion was made by James Nowlin, seconded by Kenneth Jennings and unanimously carried, authorizing the payment of the invoices for the period of July 11, 2007, to August 14, 2007, in the amount of $21,354.69.
PUBLIC COMMENT
Ms. Jane Williams of 311 Goat Island Road, Gladys, VA, appeared before Council to request waiver of the fees for the use of the softball field for Let Go of the Pain Ministries’ softball tournament on September 14 and 15, 2007. Upon motion by Kenneth Jennings, seconded by Tracy Meisenbach, and unanimously carried, Council approved the use of the softball field by Let Go of the Pain Ministries at no charge.
Mr. Gene Moorefield of 15035 L. P. Bailey Highway, Nathalie, VA appeared before Council to discuss torte liability and the railroad crossing at the intersection of the stoplight and Route 40. He informed the Council that 6000 cars pass this railroad crossing per day. He stated that he wanted to see this railroad crossing improved. Interim Town Manager Mike Crews informed Mr. Moorefield and the Council that he was making progress in getting the crossing fixed and that he had talked with Mr. Scott Snow with Norfolk Southern in Roanoke.
POLICE REPORT
Chief Ricky Cousins informed Council that the Police Department did not receive the DMV Grant they applied for in April of this year.
PUBLIC WORKS REPORT
Public Works Director and Interim Town Manager Mike Crews informed Council that the Town was collecting lead and copper samples for the Department of Health. These samples for lead and copper are done every three years. He also informed Council that letters were being sent out as required by the Department of Health advising water customers that the Town was without a Class 3 Water & Wastewater Operator from July 28, 2007 until August 9, 2007. The Town has hired Mr. Daily Hamlor, who is a Class 1 Water & Wastewater Operator to come in and oversee operations at the Water & Wastewater Treatment Plant on a temporary basis until someone can be hired.
RESOLUTION FOR THE WILLIAM CAMPBELL SOFTBALL TEAM
Mayor Phyllis Campbell presented the following resolution to Rasheeda Crews, a representative from the William Campbell Softball Team:
RESOLUTION OF CONGRATULATIONS
WILLIAM CAMPBELL SOFTBALL TEAM
VIRGINIA STATE CHAMPIONS – REGION B
WHEREAS, the William Campbell High School Softball team finished the 2007 season with a 7-1 record, and
WHEREAS, this outstanding record culminated in William Campbell High School being crowned the Region B Dogwood District State Champions for the Commonwealth of Virginia, and
WHEREAS, this championship accomplishment was the First Softball Championship in the School’s history with a Final Season Record 25-3 establishing the William Campbell High School Softball team as a recognized leader in the sport and a team that deserves the highest respect for their accomplishment, and
WHEREAS, the players have been under the leadership of Coach Chris Smith and his Assistant Brian Bowles during the entire 2007 season and they has been the guiding force behind the development of a team strategy that made the team’s offense and defense the best in the Commonwealth, and
WHEREAS, the fact that a number of the 2007 team players received All Dogwood District, All Region, and All State honors speaks to the quality of the team as a whole and the respect that is held by Coach Smith’s peers in naming him “Coach of the Year”, and
WHEREAS, through the support of the William Campbell High School faculty, student body, and parents, this team has been allowed to reach the pinnacle of success in high school softball which is richly deserved.
NOW THEREFORE BE IT RESOLVED, that the Brookneal Town Council does hereby extend its sincere congratulations to the 2007 William Campbell softball team for its accomplishments throughout the season and in particular being crowned the Region B State Champions for the Commonwealth of Virginia.
BE IT ALSO RESOLVED, that the Brookneal Town Council is extremely proud of how the William Campbell High School faculty, students, parents, and of course, the softball team itself, represented our community in its journey to softball history.

At the June 10, 2007 meeting upon motion by James Nowlin, seconded by Kenneth Jennings and unanimously approved, Council had approved this resolution.
USDA LETTER OF CONDITIONS AND RESOLUTION
Be it resolved that motion was made by Kenneth Jennings, seconded by Tracy Meisenbach, and unanimously carried, proceeding with and accepting the letter of conditions and the resolution for USDA as follows:
RESOLUTION OF GOVERNING BODY OF THE TOWN OF BROOKNEAL
The governing body of the Town of Brookneal consisting of 7 members, in a duly called meeting held on the 14th day of August 2007, at which a quorum was present RESOLVED as follows;
BE IT HEREBY RESOLVED that, in order to facilitate obtaining financial assistance from the United States of America, acting by and through the Rural Utilities Service, an agency of the United States Department of Agriculture, (the Government) in the development of IMPROVEMENTS TO THE WATER SYSTEM OF BROOKNEAL, to serve the community, the governing body does hereby adopt and abide by the covenants contained in the agreements, documents, and forms required by the Government to be executed.
BE IT FURTHER RESOLVED that the Mayor Phyllis L. Campbell of the Town Council be authorized to execute on behalf of the Town of Brookneal the above-referenced agreements and to execute such other documents including, but not limited to, debt instruments and security instruments as may be required in obtaining the said financial assistance.
This Resolution, along with a copy of the above-referenced documents, is hereby entered into the permanent minutes of the meetings of this Board.

COMMITTEE RECOMMENDATIONS
Upon motion by Tracy Meisenbach, seconded by James Nowlin and unanimously carried, Council voted to forgive personal property taxes from December 31, 1997 back to January 1, 1990 and to authorize the clerk, Bobbie Waller, to seek judgment on those from January 1, 1998 to December 31, 2001.
ITEMS FROM TOWN COUNCIL
Councilperson Meisenbach discussed an arts-funded grant that she has been reading about that would fund money for supplies for local art students to paint murals or decorations on buildings. Her thoughts were directed toward having something painted on the Kersey building facing the by-pass and Hwy 40. She said she would find out more information about it if Council was interested. Councilperson Jean asked Councilperson Meisenbach to find out more information about this grant.
CLOSED SESSION UNDER VA CODE 2.2-3711 (A)(7) FOR A BRIEFING BY STAFF MEMBERS
Upon motion by Stacey Hailey, seconded by Robert Jean, and unanimously carried, Council voted to convene in closed session, pursuant to $2.2-3711 (A) 7 of the Code of Virginia, 1950, as amended, for the purpose of briefings by staff members pertaining to actual litigation, where such briefing in open meeting would adversely affect the negotiating or litigating posture of the public body, specifically being briefed by staff regarding the pending lawsuit filed against the Town by Laurie Francis.
CERTIFICATION
Mayor Campbell called for a vote certifying that only those items were discussed as allowed under 2.2-3711 (A) 7 of the Code of Virginia, 1950, as amended, for the purpose of briefings by staff members pertaining to actual litigation, where such briefing in open meeting would adversely affect the negotiating or litigating posture of the public body, specifically being briefed by staff regarding the pending lawsuit filed against the Town by Laurie Francis.
