MINUTES OF THE BROOKNEAL TOWN COUNCIL

7:00 PM – The regular meeting of the Brookneal Town Council

 

The municipal government of the Town of Brookneal met with the following members present:

 

Phyllis Campbell, Mayor

James Nowlin, Vice Mayor

Meg Tibbs, Kenneth Jennings, Tracy Meisenbach, Richard Adams, and Stacey Hailey Council Members

Bill Gillespie, Town Manager

Laurie C. Francis, Clerk/Treasurer

Mike Crews, Public Works Director

Ricky Cousins, Police Chief

 

 

INVOCATION AND PLEDGE OF ALLEGIANCE TO THE FLAG

APPROVAL OF AGENDA

 

Upon motion by Richard Adams, seconded by James Nowlin and unanimously carried, Council approved the agenda for the September 13, 2005, regular meeting of the Brookneal Town Council with the following addition: 1) Transfer of Appropriation for the Public Works Department

 

 

MINUTES

 

Upon motion by Kenneth Jennings, seconded by Meg Tibbs and unanimously carried, Council approved the August 9, 2005 minutes.

 

 

TREASURER’S REPORT

 

The August 2005 Treasurer’s report was filed for audit.

 

 

PRESENTATION AND APPROVAL OF INVOICES

 

Be it resolved that motion was made by James Nowlin, seconded by Meg Tibbs and unanimously carried, authorizing the payment of the invoices for the period of August 9, 2005 to September 12, 2005 in the amount of $41,531.97.

 

 

PUBLIC COMMENT

Mr. Patrick Boggs of 203 Charlotte Street appeared before council on behalf of the Cunningham and Francis families to request use of the ballpark on October 15, 2005 for a benefit fundraiser for Cassidy Francis.  Although there was some conflict concerning the date, Mike Crews assured Council that the conflict could be worked out to accommodate the request for use of the ballpark.  Upon motion by James Nowlin, seconded by Stacey Hailey and unanimously carried, Council voted to allow use of the ballpark for the fundraiser.

 

 

POLICE REPORT

Chief Cousins presented council with a memo from the Central Virginia Criminal Justice Academy advising that Council needs to adopt National Incident Management Systems (NIMS) and Incident Command Systems (ICS) by September 30, 2005.  This is a requirement for continued grant funds (federal) for this year.  Upon motion by Stacey Hailey, seconded by Tracy Meisenbach and unanimously carried, Council voted to adopt NIMS and ICS.

 

 

ATTORNEY INVOICES—EEOC COMPLAINT

 

Upon motion made by Meg Tibbs, seconded by James Nowlin, and unanimously carried, Council voted to pay the two attorney invoices regarding the EEOC complaint.  One invoice was for Edmunds & Williams in the amount of $1116.00 and the other was for Overbey, Hawkins, Selz & Wright in the amount of $2567.00.

 

TRANSFER OF APPROPRIATIONS FOR POLICE DEPARTMENT, PUBLIC WORKS DEPARTMENT AND ATTORNEY FEES

 

Upon motion made by Richard Adams, seconded by Kenneth Jennings and unanimously carried, Council voted to make the following corrections to the budget:

SOURCE OF FUNDS:

 

Increase the General Fund Miscellaneous Revenue (01-1899-1300) by $4,205.00 for the payment of legal fees incurring as a result of the EEOC Complaint filed against the town.

FIRE DEPARTMENT REQUEST

 

Upon motion by Meg Tibbs, seconded by Kenneth Jennings and unanimously carried, Council voted to pay the Brookneal Fire Department $3,000 from the general fund reserve with our apologies.  These funds were a result of the town receiving $6,000 per year from the Virginia Department of Fire Programs in fiscal years 01/02, 02/03, and 03/04, but only disbursing $5,000 per year to the fire department.

 

 

BROOKNEAL LIONS CLUB REQUEST

The Brookneal Lions Club is requesting the use of the backhoe and an operator from the town to assist with their gazebo project at the Heritage Hall Nursing Home.  Mayor Campbell suggested that the request be passed to the Physical Development Committee for further discussion with the Public Works Director.

 

 

DAY IN THE TOWN

No formal chairperson was appointed for Day in the Town.  Mayor Campbell stated that she and Councilperson Tibbs would work together to organize Day in the Town.

 

 

DESIGNATION OF ACTING CLERK/TREASURER

Upon motion by James Nowlin, seconded by Tracy Meisenbach, and unanimously carried, Council appointed Bobbie Waller as Acting Clerk/Treasurer in the absence of Laurie Francis who will be taking maternity leave in October.

 

CLOSED SESSION

Upon motion from Champ Nowlin, seconded by Stacey Hailey, and unanimously carried, Council went into closed session under VA Code Section 2.2-3711 (A) (7) for the purpose of consultation with the town attorney retained by the Town of Brookneal regarding specific legal matters requiring the provision of legal advice by such council such matter being the discussion of the EEOC complaint filed against the town.

 

CERTIFICATION

Upon returning from closed session, Mayor Campbell moved that the town council certify that, in the closed meeting just concluded, nothing was discussed except the matter specifically identified in the motion to convene in a closed meeting and lawfully permitted to be so discussed under the provisions of the Virginia Freedom of Information Act cited in that motion.  Voting was as follows:
